Support for investigations; coercive measures

(1) Where the Board decides to exercise its investigatory powers under Articles 34 to 36 of Regulation (EU) No 806/2014 with the assistance of the resolution authority, the resolution authority is empowered to take the measures necessary to support the Board, in particular 1. to request the information referred to in Article 34(1) of Regulation (EU) No 806/2014 and pass it on to the Board; 2. to carry out the investigations referred to in Article 35(1) of Regulation (EU) No 806/2014; 3. to participate in on-site inspections under Article 36 of Regulation (EU) No 806/2014, in accordance with section 177.
(2) The resolution authority is competent, in the cases under Article 35(2), second subparagraph, and Article 36(5) of Regulation (EU) No 806/2014, for threatening and imposing the necessary coercive measures, and for carrying out administrative enforcement. The Administrative Enforcement Act applies correspondingly.
