Protective provisions for shareholders and creditors

Where the valuation under section 146 concludes that the losses suffered by a shareholder, creditor, or deposit guarantee scheme within the meaning of section 145(1), as a result of a resolution action, exceed the losses they would have suffered in insolvency proceedings had the action not been taken, they are entitled to a claim against the Restructuring Fund for compensation in the amount of the difference, in accordance with section 8 of the Restructuring Fund Act. The same applies to interventions in contracts under section 79(5).
