Review and assessment of recovery plans

(1) The supervisory authority submits the recovery plan to the resolution authority. The resolution authority may review the recovery plan in order to identify measures provided for in it that could adversely affect the resolvability of the institution or the group. The resolution authority may make recommendations to the supervisory authority in this regard.
(2) The supervisory authority reviews and assesses, in coordination with the Deutsche Bundesbank, the extent to which the recovery plan satisfies the requirements of sections 13 and 14. In assessing the recovery plan, the supervisory authority will also assess the adequacy of the capital and funding structure in relation to the complexity of the organisational structure and the risk profile of the institution or the group.
