(1) The Administrative Enforcement Act applies, subject to subsections (2) and (3), to the enforcement of fines and periodic penalty payments imposed by the Board under Articles 38 and 39 of Regulation (EU) No 806/2014.
(2) By way of derogation from section 3(1) and (2)(a) of the Administrative Enforcement Act, an enforcement order under Article 41(3) of Regulation (EU) No 806/2014 is required to enforce fines or periodic penalty payments imposed by the Board. The enforcement order is issued by the resolution authority following an examination confined exclusively to the authenticity of the Board's decision to be enforced. By way of derogation from section 3(4) of the Administrative Enforcement Act, the enforcement direction is issued by the resolution authority at the Board's request.
(3) By way of derogation from section 5 of the Administrative Enforcement Act, enforcement may be suspended only by a decision of the Court of Justice.
