Section 6a

Special tasks

(1) Where facts exist that suggest that deposits accepted by an institution, other assets entrusted to the institution, or a financial transaction, serve, or, in the case of a financial transaction being carried out, would serve, the financing of terrorism under section 89c of the Criminal Code or the financing of a terrorist organisation under section 129a, including in conjunction with section 129b, of the Criminal Code, the Federal Institute may 1. issue instructions to the institution's management, 2. prohibit the institution from making dispositions from an account or custody account held with it, 3. prohibit the institution from carrying out other financial transactions.
(2) Facts within the meaning of subsection (1) as a rule exist in particular where the holder of an account or custody account, the person authorised to dispose of it, or the customer of an institution, is a natural or legal person, or another association of persons, whose name has been included in the list adopted by the Council of the European Union in connection with combating terrorism, under Council Common Position 2001/931/CFSP of 27 December 2001 on the application of specific measures to combat terrorism (OJ EC No L 344, p. 93), as amended from time to time.
(3) The Federal Institute may, in an individual case, on the application of the affected natural or legal person or other association of persons, release assets subject to an order under subsection (1), insofar as they serve to cover the necessary living expenses of the person or their family members, the payment of maintenance or alimony, or comparable purposes.
(4) An order under subsection (1) must be lifted as soon as, and to the extent that, the ground for the order no longer exists.
(5) The institution or another aggrieved party may lodge an objection against an order under subsection (1).
(6) The possibility of ordering restrictions on the movement of capital and payments under section 4(1) of the Foreign Trade and Payments Act remains unaffected.
