Electronic communication; power to issue a statutory instrument

(1) Administrative acts issued on the basis of this Act may be notified electronically under section 4f of the Act on the Federal Financial Supervisory Authority, or served electronically under section 4g of the Act on the Federal Financial Supervisory Authority.
(2) The Federal Ministry of Finance is empowered, by statutory instrument not requiring the consent of the Bundesrat, in consultation with the Deutsche Bundesbank, to
1. provide rules under which the addressees named in this Act may be required to
a) establish electronic access to the procedures named in subsection (1), and
b) use the procedures named in subsection (1); and
2. make further provisions
a) on access to the electronic communication procedures named in subsection (1), and
b) on carrying out and using the electronic communication named in subsection (1). The Federal Ministry of Finance may, by statutory instrument, transfer the power to the Federal Institute, on the condition that the statutory instrument is issued in consultation with the Deutsche Bundesbank.
