Relationship of the administrator to the undertaking maintaining the register and to the refinancing undertaking

(1) The administrator is entitled to inspect, at any time, the books and papers of the undertaking maintaining the register, unless they bear no relation to the maintenance of the refinancing register. In the cases under section 22b, the administrator has the same powers also as against the refinancing undertaking.
(2) The administrator is required to maintain confidentiality regarding all facts of which the administrator becomes aware through inspecting the books and papers of the undertaking maintaining the register or of the refinancing undertaking, where different. The administrator may provide information or make notifications to the Federal Institute only regarding facts connected with monitoring the refinancing register.
(3) Disputes between the administrator and the undertaking maintaining the register, or the refinancing undertaking where different, are decided by the Federal Institute.
