Penal provisions

(1) Whoever, contrary to section 25c(4a) or section 25c(4b), second sentence, fails to ensure that an institution or a group named therein has a strategy, process, procedure, function, or concept named therein, and thereby brings about a threat to the continued existence of the institution, the superordinate undertaking, or an institution belonging to the group, is liable to imprisonment not exceeding five years or to a fine.
(2) Whoever, in the cases under subsection (1), brings about the danger negligently is liable to imprisonment not exceeding two years or to a fine.
(3) The act is punishable only where the Federal Institute has, by order under section 25c(4c), required the offender to remedy the infringement of section 25c(4a) or section 25c(4b), second sentence, the offender has acted contrary to this enforceable order, and has thereby brought about the threat to continued existence.
