Section 12

Potentially systemically important institutions

The supervisory authority determines annually, in agreement with the Deutsche Bundesbank, which institutions, parent institutions, parent financial holding companies, mixed financial holding companies, EU parent institutions, EU parent financial holding companies, or mixed EU parent financial holding companies with their registered office in Germany are potentially systemically important. The institutions and companies named above are potentially systemically important where they
1. are a global systemically important institution under section 10f, or
2. are an other systemically important institution under section 10g, or
3. are to be determined as such for other reasons, in particular on account of their size, interconnectedness, scope and complexity, or the nature of their business activity.
