Granting access under Articles 7 and 8 of Regulation (EU) No 648/2012

A central counterparty to which authorisation has been granted under Article 14 of Regulation (EU) No 648/2012 must inform the Federal Institute, in writing or electronically and without delay, of the receipt of applications for the grant of access under Article 7 of Regulation (EU) No 648/2012, and of the submission of an application for the grant of access under Article 8 of Regulation (EU) No 648/2012. The Federal Institute may 1. under the conditions named in Article 7(4) of Regulation (EU) No 648/2012, prohibit the central counterparty from granting access within the meaning of Article 7 of that Regulation, or 2. under the conditions named in Article 8(4) of Regulation (EU) No 648/2012, prohibit the central counterparty from establishing access to a trading venue within the meaning of Article 8 of that Regulation.
