(1) In restaurants, points of sale or otherwise in public, 1. beer, wine, wine-like beverages or sparkling wine, or mixtures of beer, wine, wine-like beverages or sparkling wine with non-alcoholic beverages, may not be supplied to, nor may their consumption be permitted by, children and young persons under 16, and 2. other alcoholic beverages, or foodstuffs containing other alcoholic beverages in more than a negligible quantity, may not be supplied to, nor may their consumption be permitted by, children and young persons.
(2) Paragraph 1 no. 1 does not apply where young persons are accompanied by a person with the right of custody.
(3) Alcoholic beverages may not be offered from vending machines in public. This does not apply where a vending machine is 1. installed at a place inaccessible to children and young persons, or 2. installed in a commercially used room and it is ensured, by technical devices or by constant supervision, that children and young persons cannot obtain alcoholic beverages from it. Section 20 no. 1 of the Catering Trade Act remains unaffected.
(4) Alcoholic sweet beverages within the meaning of section 1(2) and (3) of the Alcopops Tax Act may be placed on the market on a commercial basis only bearing the notice "Sale to persons under 18 prohibited, section 9 Youth Protection Act". This notice must appear on the pre-packaged product in the same typeface and in the same size and colour as the brand or fantasy name or, where none exists, as the trade description, and must, in the case of bottles, be affixed on the front label.
