Maintenance of the list of media endangering young persons

(1) The Federal Agency maintains the list of media endangering young persons under section 17a(1).
(2) Decisions on inclusion in the list, or on removal from the list, must be carried out without delay. The list must be corrected without delay where decisions of the Review Board for Media Harmful to Young Persons are set aside or cease to have effect.
(2a) The list of media endangering young persons must be maintained as a public list. Where, however, the publication of a medium in the public list would harm the safeguarding of the protection of children and young persons, that medium must be maintained in a non-public part of the list. Such harm is to be assumed in particular where a designation of the medium in the public list can be made only in a manner that simultaneously enables children and young persons direct access, through the designation.
(3) Where a medium is included in, or removed from, the public part of the list, this must be published in the Federal Gazette, with a reference to the underlying decision.
(4) The Federal Agency may communicate the list, in a suitable form, to the central supervisory authority of the Länder for the protection of minors in the media, to the bodies of self-regulation recognised in the area of digital services, and to the internet complaints offices funded from resources of the Federation, the Länder or the Land media authorities, so that the content of the list can be used to compare offerings in digital services with media included in the list, in order to enable children and young persons access to offerings that is as free of danger as possible, and to simplify the handling of reports of content endangering young persons. The communication includes a reference to assessments under section 18(6).
(5) With regard to carrier media and digital services included in the list of media endangering young persons before the expiry of 30 April 2021, section 18(2) and section 24(2), as in force until that day, continue to apply. Carrier media whose inclusion in the list of media endangering young persons was published by 30 April 2021 may be transferred, naming list parts A or B, into a joint list structure with the list to be maintained from that day.
