(1) Media impairing development under section 10a no. 1 include in particular media that are excessively frightening, that approve of violence, or that impair the social-ethical value system.
(2) In assessing whether development is impaired, circumstances of the particular use of the medium lying outside the effect of the media content may also be taken into account, where these are a permanent component of the medium and justify a differing overall assessment beyond a labelling under section 14(2a).
(3) In particular, risks to the personal integrity of children and young persons that may arise in the course of using the medium, and that are, on a concrete risk prognosis, to be classified as significant, must be appropriately taken into account, including any precautionary measures within the meaning of section 24a(1) and (2). These include in particular risks from communication and contact functions, from purchase functions, from gambling-like mechanisms, from mechanisms promoting excessive media use behaviour, from the disclosure of subscriber and usage data to third parties without consent, and from purchase appeals not appropriate to the relevant age group, in particular through promotional references to other media.
