Composition of the Review Board for Media Harmful to Young Persons

(1) The Review Board for Media Harmful to Young Persons consists of 1. the chair, 2. one assessor each, to be appointed by each Land government, and 3. further assessors to be appointed by the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth. The chair is appointed by the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth. The agency management shall propose for this a person employed at the Federal Agency who possesses the qualification for judicial office under the German Judiciary Act. The agency management may also itself hold the chair. At least one deputy must be appointed for the chair and for each of the assessors. The respective Land government may transfer its right of appointment under the first sentence, no. 2 to a supreme Land authority.
(2) The assessors to be appointed by the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth must be drawn, on the proposal of the groups named, from the circles of 1. the arts, 2. literature, 3. the book trade and publishing, 4. providers of image carriers and of digital services, 5. providers of voluntary youth welfare assistance, 6. providers of public youth welfare assistance, 7. the teaching profession, and 8. the churches, the Jewish religious communities, and other religious communities that are corporations under public law. Circles engaged in a comparable activity in the exploitation and distribution of media, independent of the type of recording and reproduction, are treated as equivalent to the book trade and publishing and to providers of image carriers and of digital services.
(3) The chair and the assessors are appointed for a term of three years. They may be removed early by the body that appointed them, where they fail to fulfil their duty to cooperate in the work of the Review Board for Media Harmful to Young Persons.
(4) The members of the Review Board for Media Harmful to Young Persons are not bound by instructions in their decisions.
(5) The Review Board for Media Harmful to Young Persons decides in a composition of twelve members, consisting of the chair, three assessors of the Länder, and one assessor each from the groups named in paragraph 2. Where assessors, or their deputies, convened for a session fail to appear, the Review Board for Media Harmful to Young Persons is also quorate in a composition of at least nine members, of whom at least two must belong to the groups named in paragraph 2 nos. 1 to 4.
(6) A majority of two-thirds of the members of the Review Board for Media Harmful to Young Persons participating in the decision is required to order inclusion in the list. In the composition under paragraph 5, second sentence, a minimum of seven votes is required for inclusion in the list.
