(1) The Federal Agency for Child and Youth Protection in the Media is, under section 12(2), first sentence of the Digital Services Act (national implementing act), the competent authority for enforcing Article 28(1) of Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act) (OJ L 277, 27.10.2022, p. 1; L 310, 1.12.2022, p. 17), under which providers of online platforms accessible to minors must take appropriate and proportionate measures to ensure a high level of privacy, safety and security for children and young persons within their service (precautionary measures).
(2) Precautionary measures include in particular: 1. providing a reporting and remedy procedure with a user interface suitable for children and young persons, under which, in particular, minor users can report to the service provider impairments of their personal integrity caused by user-generated information; 2. providing a rating system for user-generated audiovisual content, by which users are, by default, prompted in particular, in connection with generation, to rate the suitability of content according to the age group "18 and over" as suitable for adults only; 3. providing technical means of age verification for user-generated audiovisual content that the user has, in connection with generation, rated as suitable for adults only according to the age group "18 and over"; 4. an easily findable reference to advice services, help and reporting facilities independent of the provider; 5. providing technical means for persons with the right of custody to control and accompany the use of the offerings; 6. establishing default settings that limit usage risks for children and young persons, having regard to their age, in particular, without express consent stating otherwise, by ensuring that a) user profiles can neither be found by search services nor viewed by persons not logged in, b) location and contact data and communication with other users are not published, c) communication with other users is restricted to a circle previously selected by the users themselves, and d) use takes place anonymously or under a pseudonym.
(3) Section 24b(3) applies accordingly to the enforcement of Article 14(3) of Regulation (EU) 2022/2065.
(4) Sections 2 and 3 of the Digital Services Act (national implementing act), and the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016, p. 1; L 314, 22.11.2016, p. 72; L 127, 23.5.2018, p. 2), remain unaffected.
