(1) For the purposes of this Act: 1. "children" means persons who have not yet reached the age of 14, 2. "young persons" means persons who are 14 but have not yet reached the age of 18, 3. "person with the right of custody" means whoever, alone or jointly with another person, has the right of custody under the provisions of the Civil Code, 4. "person entrusted with upbringing" means any person over 18, insofar as they permanently or temporarily perform upbringing tasks on the basis of an agreement with the person having the right of custody, or insofar as they supervise a child or young person within the framework of training or youth welfare assistance.
(1a) "Media" for the purposes of this Act means carrier media and digital services, as well as separable content within a digital service in the sense of a unit of assessment.
(2) "Carrier media" for the purposes of this Act means media with texts, images or sounds on physical carriers that are suitable for being passed on, intended for direct perception, or built into a viewing or playing device. Electronic distribution, transfer, offering or making accessible of carrier media is treated as equivalent to physical distribution, transfer, offering or making accessible, insofar as it does not constitute broadcasting within the meaning of section 2 of the Interstate Broadcasting Treaty.
(3) "Digital services" for the purposes of this Act means digital services within the meaning of section 1(4) no. 1 of the Digital Services Act (national implementing act).
(4) "Mail order" for the purposes of this Act means any transaction for consideration that is carried out by way of ordering and sending goods by post or electronically, without personal contact between supplier and orderer, or without it being ensured by technical or other precautions that no dispatch is made to children or young persons.
(5) Sections 2 to 14 of this Act do not apply to married young persons.
(6) "Service providers" for the purposes of this Act means service providers under the Digital Services Act (national implementing act), as amended from time to time.
