Provisions on administrative fines

(1) A person acts unlawfully who, intentionally or recklessly, fails to submit, or fails to submit correctly, completely or in time, an annual financial statement together with the corresponding audit report, contrary to section 34(1).
(2) A person acts unlawfully who, intentionally or negligently, 1. fails to give, or fails to give correctly, completely or in time, information, or fails to submit, or fails to submit correctly, completely or in time, a document, contrary to section 34(1), or 2. fails to give, or fails to give correctly, completely or in time, information, contrary to section 41(4).
(3) The regulatory offence may be punished with an administrative fine of up to one hundred thousand euros.
(4) The administrative authority within the meaning of section 36(1), no. 1 of the Act on Regulatory Offences is BaFin.
