(1) Compensation is excluded where no transaction has taken place in connection with the deposit in the last 24 months and the value of that deposit is lower than the administrative costs on average incurred by the deposit guarantee scheme in a compensation.
(2) Satisfaction of the claim to compensation may, by way of derogation from section 14(3), be deferred where
1. the depositor's claim to compensation is disputed,
2. no transactions have taken place in connection with the deposit in the last 24 months,
3. the amount to be compensated forms part of a temporarily higher coverage level under section 8(2), or
4. the depositor is not unrestrictedly entitled to dispose of the deposit. The claim to compensation must be satisfied, in the case of the first sentence, no. 4, within three months after BaFin determines the compensation event, and in the other cases within a reasonable period.
(3) Satisfaction of the claim to compensation may be suspended where
1. the deposit is the subject of legal proceedings, until a final decision on the proceedings,
2. the deposit is subject to restrictive measures imposed by a competent German authority or by the European Union or by another state or international organisation, and legally binding on the Federal Republic of Germany, until those measures are lifted, or
3. facts indicate that the claim to compensation relates to assets connected with money laundering or terrorist financing, and an investigation has for that reason been initiated against persons, until the conclusion of that investigation.
