Audit report

(1) Deposit guarantee schemes must appoint an auditor or an audit firm to examine the completeness of the annual report and the accuracy of the particulars. Deposit guarantee schemes must notify BaFin of the appointed auditor without delay after the appointment. BaFin may, within one month after receipt of the notification, require the appointment of a different auditor, where this is required to achieve the purpose of the audit; an objection and an action for annulment against this have no suspensive effect.
(2) The auditor must submit the report on the audit of the annual report to BaFin and the Deutsche Bundesbank without delay after completing the audit.
(3) Deposit guarantee schemes must, on request, also inform BaFin and the Deutsche Bundesbank about the particulars contained in the annual report under section 52(2). Section 9 of the Banking Act applies accordingly.
