Deposits not eligible for compensation

The following deposits are not compensated under section 5:
1. deposits that other CRR credit institutions have made in their own name and for their own account,
2. own funds within the meaning of Article 4(1), point 118 of Regulation (EU) No 575/2013,
3. deposits arising in connection with transactions on the basis of which persons have been convicted in criminal proceedings for money laundering within the meaning of Article 1(2) of Directive 2005/60/EC of the European Parliament and of the Council of 26 October 2005 on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing (OJ L 309, 25.11.2005, p. 15),
4. deposits of financial institutions within the meaning of Article 4(1), point 26 of Regulation (EU) No 575/2013,
5. deposits of investment firms within the meaning of Article 4(1), point 1 of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments amending Council Directives 85/611/EEC and 93/6/EEC and Directive 2000/12/EC of the European Parliament and of the Council and repealing Council Directive 93/22/EEC (OJ L 145, 30.4.2004, p. 1),
6. deposits that are no longer available and for which the identity of the holder has never been established under Article 9(1) of Directive 2005/60/EC,
7. deposits of insurance undertakings and of reinsurance undertakings within the meaning of Article 13, points 1 to 6 of Directive 2009/138/EC of the European Parliament and of the Council of 25 November 2009 on the taking-up and pursuit of the business of Insurance and Reinsurance (Solvency II) (OJ L 335, 17.12.2009, p. 1),
8. deposits of collective investment undertakings within the meaning of Article 4(1), point 7 of Regulation (EU) No 575/2013,
9. deposits of pension and retirement funds, in particular of institutions for occupational retirement provision within the meaning of Article 6(a) of Directive 2003/41/EC of the European Parliament and of the Council of 3 June 2003 on the activities and supervision of institutions for occupational retirement provision (OJ L 235, 23.9.2003, p. 10),
10. deposits of public authorities, in particular public authorities of the Federation, of a Land, of a legally dependent special fund of the Federation or of a Land, of a local authority, of another state or of a regional government or local authority of another state, and
11. debt securities of a CRR credit institution and liabilities arising from own acceptances and promissory notes, other than registered debt instruments and registered debt securities that are deposits within the meaning of section 2(3).
