(1) The Bundesanstalt may in particular require exchanges and operators of markets on which financial instruments are traded to transmit, in standardised electronic form, the data necessary for the performance of the Bundesanstalt's tasks under section 54, under Article 4 of Regulation (EU) No 596/2014, under Article 27 of Regulation (EU) No 600/2014, and under the Commission delegated acts and implementing acts adopted on the basis of those Articles and on the basis of Article 57 of Directive 2014/65/EU. The Bundesanstalt may, in particular on the basis of the notifications it receives under Article 4 of Regulation (EU) No 596/2014, publish on its website information on which issuer has applied for, or been granted, admission of its financial instruments to trading on a trading venue, and which financial instruments are concerned.
(2) The Bundesanstalt may in particular require information and the reporting of transactions in commodity derivatives from market participants active on spot markets within the meaning of Article 3(1), point 16 of Regulation (EU) No 596/2014, insofar as necessary, on the basis of indications, for monitoring compliance with a prohibition under Articles 14 and 15 of Regulation (EU) No 596/2014 in relation to commodity derivatives. Under the conditions of the first sentence, the Bundesanstalt must further be granted direct access to the trading systems of traders. The Bundesanstalt may require the information under the first sentence to be transmitted in standardised form. Section 6(15) applies correspondingly.
(3) The Federal Ministry of Finance may, by statutory instrument not requiring the consent of the Bundesrat, adopt further provisions on the content, nature, scope and form of the communications to be transmitted under subsection (1), first sentence, and subsection (2), and on the permissible data carriers and transmission channels, as well as on the form, content, scope and presentation of the publication under subsection (1), second sentence. The Federal Ministry of Finance may transfer this authorisation, by statutory instrument, to the Bundesanstalt.
