Supervision of the organisational obligations

The Bundesanstalt may, even without any particular occasion, carry out examinations at data reporting services providers to monitor the obligations under section 58 and under Title IVa of Regulation (EU) No 600/2014, including in conjunction with delegated acts and implementing acts adopted under Article 27g(6) to (8) and Article 27i(5) of that Regulation, in the context of an exemption under Article 2(3) of that Regulation. Section 88(3) applies correspondingly. As regards the scope of the examinations, section 88(2) applies correspondingly. An objection and an action for rescission against measures under the first sentence have no suspensive effect.
