Transitional provision for the notification and publication obligations of holders of net short positions under section 30i in the version of this Act of 6 December 2011 (Federal Law Gazette I, p. 2481)

(1) Any person who, on 26 March 2012, holds a net short position under section 30i(1), first sentence, in the version of this Act of 6 December 2011 (Federal Law Gazette I, p. 2481), of 0.2 per cent or more, must notify it to the Bundesanstalt by the end of the next trading day, under section 30i(3) of the aforementioned version of this Act, including in conjunction with a statutory instrument under section 30i(5) of the aforementioned version of this Act. The holder of a net short position under section 30i(1), second sentence, of the aforementioned version of this Act of 0.5 per cent or more must, in addition to their notification under the first sentence, publish it in the Federal Gazette within the time limit of the first sentence, under section 30i(3) of the aforementioned version of this Act, including in conjunction with a statutory instrument under section 30i(5) of the aforementioned version of this Act; no such obligation exists where an equivalent notification has already been given before 26 March 2012.
(2) It is a regulatory offence for any person who, intentionally or recklessly, 1. fails to make a notification, or fails to make it correctly, completely, in the prescribed manner or in time, contrary to subsection (1), first sentence, or 2. fails to make a publication, or fails to make it correctly, completely, in the prescribed manner or in time, contrary to subsection (1), second sentence, first half-sentence.
(3) The regulatory offence may, in the cases under subsection (2), be sanctioned with a fine of up to two hundred thousand euros.
