Cooperation with the European Securities and Markets Authority

(1) The Bundesanstalt makes available to the European Securities and Markets Authority, without delay on request, in accordance with Articles 35 and 36 of Regulation (EU) No 1095/2010, all information necessary for the performance of its tasks.
(2) The Bundesanstalt transmits to the European Securities and Markets Authority annually a summary of information on all administrative measures taken and sanctions imposed in connection with supervision under Parts 9 to 11.
(3) The Bundesanstalt informs the European Securities and Markets Authority of the lapse of an authorisation under section 4(4) of the Stock Exchange Act, and of the revocation of an authorisation under section 4(5) of the Stock Exchange Act or under the provisions of the administrative procedure acts of the Länder.
(4) The Bundesanstalt transmits to the European Securities and Markets Authority and to the competent authorities of the other Member States of the European Union and of the states party to the Agreement on the European Economic Area the information transmitted under section 72(6) of this Act, section 7(5), fifth sentence of the Stock Exchange Act, and section 8(4a) of the Stock Exchange Act. Where there are indications of breaches of the provisions of Regulation (EU) No 596/2014, the Bundesanstalt transmits information only once it is satisfied that a breach has occurred.
