(1) Section 37n and section 37o(1), fourth sentence, and the provisions of Part 11, Chapter 2, in the version of the Act of 5 January 2007 (Federal Law Gazette I, p. 10), apply for the first time to financial reports for the financial year beginning after 31 December 2006.
(2) For issuers whose only securities admitted to trading on a regulated market within the meaning of Article 4(1), point 14, of Directive 2004/39/EC of the European Parliament and of the Council of 21 April 2004 on markets in financial instruments (OJ EU No. L 145, p. 1) in a Member State of the European Union or in another contracting state of the Agreement on the European Economic Area are debt securities, and for issuers whose securities are admitted to trading in a third country and who, for that purpose, have applied internationally recognised accounting standards since the financial year that began before 11 September 2002, section 37w(3), second sentence, and section 37y, point 2, in the version of the Act of 5 January 2007 (Federal Law Gazette I, p. 10), apply with the proviso that the issuer may, for financial years beginning before 31 December 2007, apply the accounting principles of the respective prior year's financial statements.
(3) Section 30b(3), point 1, letter a, in the version of the Act of 5 January 2007 (Federal Law Gazette I, p. 10), applies for the first time to information transmitted after 31 December 2007.
