(1) The manufacturer may, by written mandate, designate an authorised representative.
(2) The authorised representative carries out the tasks assigned to it by the manufacturer, for and on behalf of the manufacturer.
(3) A manufacturer that appoints an authorised representative must assign to it at least the following tasks: 1. to keep the EU declaration of conformity and the technical documentation under section 6(2) available for the market surveillance authority for five years; 2. to provide the market surveillance authority with all information under section 7(5), first sentence, and hand over to it all documents under section 7(5), first sentence; 3. to cooperate with the market surveillance authority, at its request, on any action taken to bring the products concerned into conformity, insofar as those products fall within the authorised representative's mandate.
(4) The manufacturer may not delegate to an authorised representative the obligations under section 6(1) no. 1 or the obligation to draw up the technical documentation under section 6(1) no. 2.
