EU declaration of conformity for products

(1) Before a product whose conformity with the accessibility requirements of the statutory instrument to be issued under section 3(2) has been demonstrated by the procedure under Annex 2 is placed on the market, the manufacturer must draw up an EU declaration of conformity.
(2) The EU declaration of conformity must state that meeting the accessibility requirements of the statutory instrument to be issued under section 3(2) has been demonstrated. Where the possibility of derogation under section 16 or 17 has been used, the EU declaration of conformity must state which accessibility requirements are subject to that derogation.
(3) The EU declaration of conformity follows the structure of the model set out in Annex III to Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products, and repealing Council Decision 93/465/EEC (OJ L 218, 13.8.2008, p. 82). It contains the elements specified in Annex 2 and is kept up to date. It is translated into German. The requirements as to technical documentation must not impose a disproportionate burden on microenterprises and small and medium-sized enterprises.
(4) Where a product is subject to more than one legal act of the European Union each requiring an EU declaration of conformity, the manufacturer, or a representative authorised by it, must draw up a single EU declaration of conformity in respect of all such legal acts of the European Union. That declaration must identify the legal acts concerned, together with their publication references.
