Section 10

Importer's special marking and information obligations

(1) The importer must indicate its name, registered trade name or registered trade mark, and its postal address, on the product at the time of placing it on the market. Where this is not possible due to the size or nature of the product, this information must be provided on the packaging or in a document accompanying the product. The contact details must be in a language easily understood by consumers.
(2) The importer must ensure that the product is accompanied by instructions for use and safety information in German that meet the requirements of the statutory instrument to be issued under section 3(2).
(3) The importer must, for five years starting from the product's placing on the market, keep a copy of the EU declaration of conformity available for the market surveillance authorities and ensure that it can make the technical documentation available to them on request.
(4) Section 7(5) applies accordingly.
