(1) A person acts unlawfully who, intentionally or negligently, 1. contrary to section 6(1) no. 1 or section 9(1), each also in conjunction with a statutory instrument under section 3(2), places a product on the market, 2. contrary to section 6(4), third sentence, also in conjunction with section 11(4), contrary to section 11(2), second sentence, or section 14(4), second sentence, each also in conjunction with a statutory instrument under section 3(2), fails to give information, fails to give it correctly, fails to give it completely, or fails to give it in time, 3. contrary to section 7(1), first sentence, also in conjunction with the second sentence, each also in conjunction with a statutory instrument under section 3(2), fails to ensure that a product bears a number or mark named there, 4. contrary to section 7(2), first sentence, also in conjunction with the second sentence, or section 10(1), first sentence, also in conjunction with the second sentence, fails to give a particular, fails to give it correctly, fails to give it completely, fails to give it in the prescribed manner, or fails to give it in time, 5. contrary to section 7(3) or section 10(2), each also in conjunction with a statutory instrument under section 3(2), fails to ensure that a product is accompanied by instructions for use and the safety information named there, 6. contrary to section 7(5), first sentence, section 13(1) or section 14(5), first sentence, fails to give information, fails to give it correctly, fails to give it completely, fails to give it in the prescribed manner, or fails to give it in time, or fails to hand over a document, fails to hand it over correctly, fails to hand it over completely, fails to hand it over in the prescribed manner, or fails to hand it over in time, 7. contrary to section 11(1) no. 1 or (2), first sentence, in conjunction with a statutory instrument under section 3(2), makes a product available on the market, 8. contrary to section 14(1), in conjunction with a statutory instrument under section 3(2), offers or provides a service, 9. contrary to section 19(1), in conjunction with a statutory instrument under section 3(2), fails to affix a CE marking to a product, fails to affix it correctly, fails to affix it completely, fails to affix it in the prescribed manner, or fails to affix it in time, or 10. contrary to section 19(3) in conjunction with Article 30(5), first sentence of Regulation (EC) No 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93 (OJ L 218, 13.8.2008, p. 30), affixes a marking, sign or inscription to a product.
(2) The regulatory offence may, in the cases under subsection (1) nos. 1, 7, 8, 9 and 10, be punished with an administrative fine of up to one hundred thousand euros, and in the other cases with an administrative fine of up to ten thousand euros.
