Tasks of the market surveillance authorities

(1) The Länder must ensure that their market surveillance authorities are able to properly carry out their tasks. To that end, they must equip them with the necessary resources. They must ensure efficient cooperation and effective exchange of information between their market surveillance authorities, and between their market surveillance authorities and those of the other Member States of the European Union.
(2) The Länder must draw up a market surveillance strategy for products within the meaning of section 1(2). In preparing it, Article 13(1) and (2) of Regulation (EU) 2019/1020 of the European Parliament and of the Council of 20 June 2019 on market surveillance and compliance of products and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011 (OJ L 169, 25.6.2019, p. 1) applies accordingly to products within the meaning of section 1(2). The Länder must transmit their market surveillance strategy under the first sentence to the central liaison office under Article 10(3) of Regulation (EU) 2019/1020.
