Legal remedies

(1) An objection and an action for annulment against administrative acts of the Digital Services Coordinator and of the authorities competent under section 12(2), first sentence and (3) implementing Regulation (EU) 2022/2065 have no suspensive effect.
(2) Paragraph 1 applies accordingly to the Federal Network Agency, where it is competent under section 22, section 22b(1) or section 22c(1).
(3) For legal remedies against a decision of the Federal Network Agency as competent authority under section 22c(1), sections 13 to 28 of the EU Consumer Protection Enforcement Act of 21 December 2006 (Federal Law Gazette I, p. 3367), as last amended by Article 18 of the Act of 15 July 2024 (Federal Law Gazette 2024 I No. 236), apply accordingly, where the Federal Network Agency takes the decision under section 28(3) or under section 30(1) in conjunction with section 202(1), (2) or (5), or in conjunction with section 207 of the Telecommunications Act. In all other respects, the provisions under paragraph 2 and the provisions on legal remedies against administrative measures remain unaffected in respect of decisions under the first sentence.
