Cooperation of the Digital Services Coordinator with the competent authorities; administrative agreement

(1) The authorities competent under section 12(2) and (3) for enforcing Regulation (EU) 2022/2065, and the Digital Services Coordinator, shall cooperate, within the scope of their respective responsibilities, in performing their tasks in a spirit of trust and cooperation. They shall communicate to each other observations and findings that may be significant for the performance of each other's tasks.
(2) The details of the cooperation under paragraph 1 may be further regulated in an administrative agreement. The administrative agreement may in particular regulate: 1. coordination of the exchange of data and information under paragraph 3, 2. a procedure for receiving and forwarding complaints under section 20.
(3) Insofar as necessary for supervision and sanctioning within the framework of enforcing Regulation (EU) 2022/2065, and for performing the Digital Services Coordinator's task as central information point under section 20, the authorities competent under section 12(2) and (3) and the Digital Services Coordinator may transmit to each other the following content and data, including personal data: 1. internet content, together with the associated subscriber and usage data of the user account of a digital service, and 2. user complaints and the corresponding communication with complainants. The Digital Services Coordinator and the authorities competent under section 12(2) and (3) may use the content and data transmitted to them in their supervisory and sanctioning proceedings. Prohibitions on the use of evidence remain unaffected.
