(1) For the exercise of the Federal Network Agency's powers as competent authority under sections 22, 22b(1) and 22c(1), section 202(1), (2) and (5), section 203(1), first sentence, (2), first sentence and (6), first and third to seventh sentences, and sections 204 to 207 of the Telecommunications Act apply accordingly.
(2) Where the Federal Network Agency is competent under section 22, section 202(4) of the Telecommunications Act applies accordingly, in addition to paragraph 1.
(3) Where the Federal Network Agency is competent under section 22c(1), it may, within the scope of its powers under paragraph 1, purchase goods and services as test purchases, where necessary under a concealed identity.
(4) Where the Federal Network Agency is competent under section 22(1), section 22b(1) or section 22c(1), it may 1. in the event of an infringement by providers of online intermediation services or providers of online search engines of their obligations under Regulation (EU) 2019/1150, as amended on 20 June 2019, by providers of their obligations under Regulation (EU) 2018/302, as amended on 28 February 2018, by service providers of their obligations under section 22c(2), first sentence, or by providers of online platforms for short-term accommodation rental services of their obligations under Article 7(2) and (3) and Article 9 of Regulation (EU) 2024/1028, as amended on 11 April 2024, accept commitments from the responsible undertakings as to compliance with these obligations, and declare these commitments binding, 2. accept additional commitments, on their own initiative, from the undertakings named in no. 1, or call on responsible undertakings to make commitments, in order to offer adequate redress to a person affected by an infringement under no. 1, and 3. require the responsible undertakings to fulfil their commitments under nos. 1 and 2.
