Part 4 · Provisions for Providers of Audiovisual Media Services and for Video-Sharing Platform Providers › Section 10

Requests for information by the authority competent under Land law

(1) Providers of audiovisual media services and video-sharing platform providers are obligated, on request, to provide the authority competent under Land law with information on the criteria named in section 2(2) to (7), insofar as this is necessary for the performance of the tasks under section 9(1), second sentence and (2).
(2) Providers of audiovisual media services and video-sharing platform providers may refuse to answer questions where answering them would expose themselves, or a relative within the meaning of section 383(1) nos. 1 to 3 of the Code of Civil Procedure, to the risk of prosecution for a criminal offence or a regulatory offence. They must be advised of their right to refuse to provide information. The fact on which the provider of audiovisual media services or the video-sharing platform provider bases the refusal to provide information under the first sentence must, on request, be shown to be credible. An affirmation on oath by the provider of audiovisual media services or the video-sharing platform provider suffices.
