Implementation of Regulation (EU) 2018/302 and enforcement of the prohibition on discriminatory provisions

(1) The Federal Network Agency is the competent authority
1. under Article 7(1) of Regulation (EU) 2018/302, as amended on 28 February 2018,
2. under Article 8 of Regulation (EU) 2018/302, as amended on 28 February 2018, and
3. for enforcing the prohibition under paragraph 2.
(2) Service providers may not make public general terms of access to a service that contain discriminatory provisions based on the nationality or place of residence of the recipient of the service. This does not apply to differences in the conditions of access that are directly justified by objective criteria.
