Contractual prohibitions on use

(1) Video-sharing platform providers are obligated to agree effectively with their users that the users may not disseminate impermissible audiovisual commercial communication on the video-sharing platform.
(2) Impermissible audiovisual commercial communication within the meaning of this provision is audiovisual commercial communication that infringes the following provisions: 1. section 20 of the Tobacco Products Act of 4 April 2016 (Federal Law Gazette I, p. 569), as last amended by Article 2(5) of the Act of 20 December 2022 (Federal Law Gazette I, p. 2752), or 2. section 10 of the Medicinal Products Advertising Act, in the version promulgated on 19 October 1994 (Federal Law Gazette I, p. 3068), as last amended by Article 6 of the Act of 11 July 2022 (Federal Law Gazette I, p. 1082).
