(1) The Federal Network Agency is the competent authority for implementing Regulation (EU) 2019/1150, as amended on 20 June 2019, where providers make their online intermediation services or online search engines available, or offer to make them available, to business users or users with a corporate website who are established or resident in the Federal Republic of Germany and who, through these online intermediation services or online search engines, offer goods or services to consumers located in the European Union. The first sentence applies regardless of the place of establishment or seat of the providers of these services and regardless of the law otherwise applicable.
(2) The Federal Network Agency is authorised to designate organisations, associations and public bodies based in Germany under Article 14 of Regulation (EU) 2019/1150.
(3) The Federal Network Agency and the Federal Cartel Office shall cooperate in a spirit of trust and cooperation. On request, they shall transmit to each other, within the framework of the applicable statutory provisions, information necessary for the performance of their respective tasks.
