(1) It is prohibited to induce others, commercially and by exploiting their inexperience in speculative exchange transactions, into such transactions or into direct or indirect participation in such transactions.
(2) Speculative exchange transactions within the meaning of subsection (1) are in particular
1. purchase or sale transactions with deferred delivery time, even where concluded outside a domestic or foreign exchange, and
2. options on such transactions, aimed at making a profit from the difference between the price fixed for the delivery time and the exchange or market price obtaining at the delivery time.
