Section 25

Suspension and discontinuation of trading

(1) The Management may 1. suspend trading in financial instruments, economic assets or rights where orderly exchange trading is temporarily endangered on account of an emergency situation, or where this appears required for the protection of the public; and 2. discontinue trading where orderly exchange trading no longer appears to be ensured. The Management is obliged to publish measures under the first sentence. Detailed provisions on publication are to be made in the Exchange Rules.
(1a) Where the suspension of trading under subsection (1), first sentence, no. 1 concerns a financial instrument within the meaning of Annex I, Section C of Directive 2014/65/EU, the Management also suspends trading in derivatives connected with that financial instrument within the meaning of Annex I, Section C, nos. 4 to 10 of that Directive, where this is necessary to achieve the objectives of the suspension of trading in the underlying financial instrument. The same applies to a discontinuation of trading under subsection (1), first sentence, no. 2.
(1b) The exchange supervisory authority and BaFin must be informed without delay of a suspension or discontinuation of trading under subsection (1) or (1a).
(2) An objection and an action for annulment against the suspension of trading have no suspensive effect.
(3) Subsection (1), second sentence and subsection (2) apply accordingly to measures under Article 23(1) of Regulation (EU) No 236/2012.
