Consent

(1) A genetic examination or analysis may be carried out, and a genetic sample required for it obtained, only where the person concerned has expressly consented in writing, to the physician responsible, to the examination and to the obtaining of the genetic sample required for it. Consent under sentence 1 covers both the decision on the scope of the genetic examination and the decision whether, and to what extent, the examination result is to be disclosed or destroyed. Consent under sentence 1 also covers consent to the processing of genetic data. A person or institution commissioned under section 7(2) may carry out the genetic analysis only where it has evidence of the consent.
(2) The person concerned may withdraw their consent at any time, with effect for the future, in writing or orally, to the physician responsible. Where the withdrawal is made orally, it must be documented without delay. The physician responsible must transmit evidence of the withdrawal to the person or institution commissioned under section 7(2) without delay.
