(1) A genetic sample may be used only for the purposes for which it was obtained. The physician responsible, or the person or institution commissioned under section 7(2), must destroy the genetic sample without delay once it is no longer needed for those purposes, or once the person concerned has withdrawn their consent under section 8(2).
(2) By way of derogation from subsection (1), the genetic sample may be used for other purposes only insofar as this is permissible under other statutory provisions, or where the person from whom the genetic sample originates has, after being informed of the other purposes, expressly consented in writing to the use.
(3) A person who uses a genetic sample must take the necessary technical and organisational measures to exclude impermissible use of the sample.
