Scope of application

(1) This Act applies to genetic examinations, and to genetic analyses carried out within the framework of genetic examinations, of born persons and of embryos and foetuses during pregnancy, and to the handling of genetic samples and genetic data obtained in the course of genetic examinations for medical purposes, for establishing parentage, and in the insurance sector and in working life.
(2) This Act does not apply to genetic examinations and analyses, and to the handling of genetic samples and data,
1. for research purposes,
2. under provisions
a) on criminal proceedings, on international mutual legal assistance in criminal matters, the Federal Criminal Police Office Act, and the police statutes of the Länder,
b) of the Infection Protection Act and the statutory ordinances issued under the Infection Protection Act.
