Genetic screening examinations

(1) A genetic screening examination may be carried out only where the examination is intended to clarify whether the persons concerned have genetic characteristics relevant to a disease or health disorder that, according to the generally recognised state of the art in science and technology, is avoidable, treatable or can be prevented.
(2) A genetic screening examination under subsection (1) may begin only once the Genetic Diagnostics Commission has assessed the examination in a written opinion. The Genetic Diagnostics Commission examines and assesses, on the basis of the documents submitted to it, whether the conditions under subsection (1) are met, whether the application concept for carrying out the examination corresponds to the generally recognised state of the art in science and technology, and whether the examination is, in this sense, ethically justifiable.
