Retention and destruction of the results of genetic examinations and analyses

(1) The physician responsible must retain the results of genetic examinations and analyses for ten years in the examination records concerning the person concerned. The physician responsible must destroy the results of genetic examinations and analyses in the examination records concerning the person concerned without delay,
1. where the retention period under sentence 1 has expired, or
2. insofar as that person has decided, under section 8(1) sentence 1 in conjunction with sentence 2, that the results of the genetic examinations and analyses are to be destroyed. Insofar as there is reason to assume that destruction would impair interests of the person concerned that warrant protection, or where the person concerned requests longer retention in writing or in electronic form, the physician responsible must, instead of destruction under sentence 2 number 1, restrict the processing of the results and notify this to the person or institution commissioned under section 7(2). Sentence 2 number 2 also applies where the person concerned has withdrawn their consent under section 8(2), insofar as the results are not already known to them.
(2) Subsection (1) applies accordingly to the retention, destruction and restriction of processing of the result of a genetic analysis by the person or institution commissioned under section 7(2).
