(1) BaFin cooperates, under Directive (EU) 2019/2162 of the European Parliament and of the Council of 27 November 2019 on the issue of covered bonds and covered bond public supervision and amending Directives 2009/65/EC and 2014/59/EU (OJ L 328, 18.12.2019, p. 29), with the following bodies:
1. the European Central Bank, insofar as the general supervision of credit institutions that are Pfandbrief banks has been transferred to it under Article 4 of Council Regulation (EU) No 1024/2013 of 15 October 2013 conferring specific tasks on the European Central Bank concerning policies relating to the prudential supervision of credit institutions (OJ L 287, 29.10.2013, p. 63; L 218, 19.8.2015, p. 82),
2. the Single Resolution Board under Article 42 of Regulation (EU) No 806/2014 of the European Parliament and of the Council of 15 July 2014 establishing uniform rules and a uniform procedure for the resolution of credit institutions and certain investment firms in the framework of a Single Resolution Mechanism and a Single Resolution Fund and amending Regulation (EU) No 1093/2010 (OJ L 225, 30.7.2014, p. 1; L 101, 18.4.2015, p. 62), as last amended by Regulation (EU) 2021/23 (OJ L 22, 22.1.2021, p. 1), where it takes resolution measures in relation to credit institutions that are Pfandbrief banks,
3. the European Banking Authority and the European Securities and Markets Authority, and
4. the supervisory authorities of the other Member States of the European Union and the other contracting states to the Agreement on the European Economic Area designated under Article 18(2) of Directive (EU) 2019/2162.
(2) BaFin communicates to the European Banking Authority, under Article 24(9) of Directive 2019/2162, the measures, fine decisions and communications in criminal matters published under section 40a, and transmits, under Article 26(3) of Directive 2019/2162, the list published under section 2(6) annually. It communicates to the supervisory authorities of the other Member States of the European Union and the other contracting states to the Agreement on the European Economic Area designated under Article 18(2) of Directive 2019/2162 those circumstances which, on an informed assessment, could have a material effect on the issuance of European covered bonds in the relevant Member State of the European Union or other contracting state to the Agreement on the European Economic Area concerned.
