Provisions on administrative fines

(1) A person acts unlawfully who, intentionally or negligently,
1. puts a Pfandbrief into circulation contrary to section 4(7), third sentence,
2. fails to make an entry correctly or completely, contrary to section 5(1), first or third sentence, including in each case in conjunction with a statutory instrument under section 5(3), first or fourth sentence, and thereby prevents the unambiguous identification of the registered asset,
3. makes an entry contrary to section 5(1), second sentence, first half-sentence,
4. fails to publish a particular named there correctly or completely, contrary to section 28(1), first sentence,
5. fails to publish a particular, or fails to publish it for at least two years, contrary to section 28(1), fourth sentence, or
6. puts a financial instrument into circulation contrary to section 41a.
(2) The regulatory offence may be punished with an administrative fine of up to five hundred thousand euros.
