Section 6a

Exhibition priority

(1) Where the applicant has displayed an invention 1. at an official or officially recognised international exhibition within the meaning of the Convention on International Exhibitions signed in Paris on 22 November 1928, or 2. at another domestic or foreign exhibition, the applicant may, where the invention is filed as a utility model within a period of six months from the first display, claim a priority right from that day.
(2) The exhibitions designated in paragraph 1 no. 1 are announced by the Federal Ministry of Justice and Consumer Protection in the Federal Gazette.
(3) The exhibitions under paragraph 1 no. 2 are determined in individual cases by the Federal Ministry of Justice and Consumer Protection and announced in the Federal Gazette.
(4) Whoever claims a priority under paragraph 1 must, before the expiry of the 16th month after the day of the first display of the invention, state that day and the exhibition, and file evidence of the display.
(5) The exhibition priority under paragraph 1 does not extend the priority periods under section 6(1).
