Section 11

Effect of registration

(1) The registration of a utility model has the effect that the holder alone is entitled to use the subject matter of the utility model. Every third party is prohibited, without the holder's consent, from manufacturing, offering, putting on the market or using a product that is the subject matter of the utility model, or from importing or possessing it for the purposes stated.
(2) The registration further has the effect that every third party is prohibited, without the holder's consent, from offering or supplying, within the territorial scope of this Act, to persons other than those entitled to use the subject matter of the utility model, means relating to an essential element of the subject matter of the utility model, for use of that subject matter within the territorial scope of this Act, where the third party knows, or it is obvious from the circumstances, that these means are suitable and intended for use for the subject matter of the utility model. The first sentence does not apply where the means are products generally available in commerce, unless the third party knowingly induces the person supplied to act in a manner prohibited under paragraph 1, second sentence. Persons who carry out the acts named in section 12 nos. 1 and 2 are not, within the meaning of the first sentence, deemed persons entitled to use the subject matter of the utility model.
