Trade secrets in litigation

In utility model litigation, with the exception of independent evidentiary proceedings, and in compulsory licence proceedings under section 20 in conjunction with section 81(1), first sentence of the Patent Act, sections 16 to 20 of the Act on the Protection of Trade Secrets of 18 April 2019 (Federal Law Gazette I, p. 466) apply accordingly. All information introduced into the proceedings by the claimant and the defendant is deemed information at issue within the meaning of section 16(1) of the Act on the Protection of Trade Secrets.
