Prior rights, prior use

(1) Utility model protection is not established by the registration insofar as any person has a claim to cancellation against the person registered as holder (section 15(1) and (3)).
(2) Where the substantive content of the registration has been taken, without the consent of another person, from that person's descriptions, drawings, models, apparatus or equipment, the protection of this Act does not arise as against the injured party.
(3) The provisions of the Patent Act on the right to protection (section 6), on the claim to grant of the protective right (section 7(1)), on the claim to assignment (section 8), on the right of prior use (section 12), and on the state order of use (section 13) apply accordingly.
